GENERAL TERMS AND CONDITIONS FOR USING THE FPPM WEBSITE

This document contains the binding terms and conditions, rules and policies, which govern the use of the website http://www.smpm.bg (Hereinafter referred to as the Website). These are the General Terms and Conditions for Using the Website, the Policy on the Personal Information Privacy and Personal Data Protection and the Rules for Using the Forum, which govern the relationships between FairPlay Property Management EOOD (FPPM) and each user of the information materials, services and resources available on the website. The use of this website is subject to these General Terms and Conditions. The information on the website is published in Bulgarian, Russian and English languages. The rules adopted by FPPM protect the interests of all visitors of the website.
This website was created to facilitate the residents of Santa Marina Holiday Village near the town of Sozopol, the property owners in the complex and the visitors, guests and people seeking information about Santa Marina Holiday Village in order to inform themselves and to facilitate their stay there.

Key Concepts

For the purpose of these General Terms and Conditions the terms below shall be interpreted as follows:
- FairPlay Property Management EOOD (FPPM) shall be interpreted as a company incorporated under the laws of the Republic of Bulgaria, which is an owner and administrator of the website.
- Santa Marina Complex (the Complex) shall be interpreted as Santa Marina Holiday Village located on the southern Black Sea coast, 2 km to the north of the ancient town of Sozopol and 34 km to the south of the town of Burgas, which consists of seasons villas for residential use.
- Informational website Http://www.smpm.bg shall be interpreted as a virtual resource, which provides the users with the information services and resources described in these General Terms and Conditions.
- User shall be interpreted as any natural person who is registered with the website and / or uses any information and / or services provided thereon.
- User Profile shall be interpreted as a separate part of the website containing information about the user, which is generated and stored by FPPM. The user profile is accessed through username and password. It allows the user to review and edit the initial data, to change the access password, to share posts on the forum and to receive information directly related to his/her property in the complex. "Username" shall be interpreted as a unique numeric code generated by FPPM, by which the user is individualized on the website.
- Password shall be interpreted as a unique numeric, letter or symbols code initially generated by FPPM for validation of the user on the website, which may be subsequently changed by the user.
- User Contents shall be interpreted as all data, information, text, files, software, music, photographs, graphics, video or audio, communications, electronic links and all other materials, including but not limited to, reviews, comments and contents of the information provided on the forum, which the user posts on the website in order to be accessible to all other users.
- The service / services on the website shall include:
o Access to the information resources / data provided through the website;
o Participation in the forums on the website by sharing reviews or comments on previously published reviews;
o Creation and customization of the user accounts through registration, which allows access to the information resources on the website;
o Sending email newsletters to the registered users.
- Partner shall be interpreted as any entity, which FPPM has entered into agreement with, which may provide additional information about its goods / services to the registered users.
- Malicious Acts of Third Parties shall be interpreted as any malicious acts or omissions of third parties which are inconsistent with the Rules of Netiquette, including but not limited to DoS (Denial of Service - overloading the server), server penetration, deface, data theft, sending spam and junk mail, etc.
- Direct Marketing - shall be interpreted as offering goods and services to the users by mail, telephone or otherwise and consultation in order to make a study on our services.
- IP Address (the IP address) shall be interpreted as a unique identification number, which connects any device, website or resource of the user in a way that allows their localization in the global Internet network.

TERMS AND CONDITIONS FOR USING THE WEBSITE

The access to and use of this website shall be subject to these General Terms and Conditions. Please, read these General Terms and Conditions for Using the Website (hereinafter referred to as the Terms and Conditions) before proceeding with its use. These Terms and Conditions constitute a contract between you and FPPM, as you, by using the website, agree to be bound by these Terms and Conditions and any subsequent amendments thereto and to comply with them. These Terms and Conditions are binding only in respect to the relationship between you, as a user of the website, and FPPM, as an owner and administrator of the website.

I. General Provisions

All information, documents, materials and illustrations published on this website are property of FairPlay Property Management EOOD (FPPM). They may be used only in strict compliance with the copyrights and with the express permission of the owner and administrator of the website. The published materials may be used for personal purposes only. The published illustrations may only be used with the text thereto and with the express permission of the owner and administrator of the website.

II. Rights and Limitations

As a user of the website, you will be entitled to use the information and services for personal and non-commercial purposes in compliance with the terms and conditions specified in this document.
1. Part of the information on the website is available to all users without registration. It includes, but is not limited to the following: access to and use of, following the rules of these Terms and Conditions, various information resources available through the website - news, calendar containing information about upcoming events, information about commercial units - restaurants, stores, bars, children's playgrounds, services provided, spa, fitness and beauty centres, hairdressing salon, travel services, sports and entertainment, administration, information about the properties in the complex, tips on the property maintenance, etc.
2. Part of the website's services is available only after registration, creation of a user profile and entering the username and password provided by FPPM. These services are intended for the property owners in the complex.
To use the services described below, the user shall make a registration by submitting an application in the electronic registration form, available in real time (on-line) on the Internet website: http://www.smpm.bg/bg/user/registration.html.
Such services include, but are not limited to the following: Internal Regulations, Forum, etc. Only the registered users will have access to these services in order to protect their interests and confidentiality of their relationships. As users - property owners in the complex they will be informed about all matters concerning their property, its maintenance, management and administration of the complex, without disclosing their data and personal information to third parties.
All users shall be entitled to review and receive information about the location and capabilities of the complex, services offered therein, upcoming events, information and advice on the properties, etc.
3. The user shall not be entitled to reproduce (in whole or in part), modify, copy, print, reissue, publish, send or transmit (in the form of e-mail, electronically or otherwise), display, rent, sell, transfer and create derivative works based on the contents of the website. Moreover, the user shall not be entitled to link, use for public or commercial purposes and disseminate in any other way the contents of this website. The contents of this website shall not be used in other websites or computer environment for any purpose whatsoever.
4. Any unauthorized use of this website or its contents (including but not limited to: sending or transmitting any materials, which content is illegal, threatening, false, misleading, abusive, libellous, obscene, vituperative, anti-competitive, defamatory, improper, scandalous, incendiary and pornographic or any other materials encouraging conduct that may be considered a criminal offense, give rise to civil or criminal liability or otherwise violate the laws of the Republic of Bulgaria) is expressly prohibited.

7. FPPM reserves the right to decline the registration of any user. FPPM expressly reserves the right to determine or change the information resources, which will require registration.
FPPM may, at any time, without a reason, deny the user access to any area protected by a password by blocking the user data, especially in cases where the user uses incorrect data for registration purposes and violates the adopted Terms and Conditions for Using the Website, the legislation, etc.
FPPM may deny access to the website at any time, especially if the user fails to fulfil any of his/her obligations under these General Terms and Conditions. By using this website, the user represents and undertakes to comply with these General Terms and Conditions, as well as with all other rules related to the use of the Internet websites established by the legislation of the Republic of Bulgaria and the international law, even if not explicitly mentioned in these General Terms and Conditions.

III. Responsibility and Limitation of the Responsibility

1. The information published on this website is provided by internal and external sources of FPPM and is constantly supplemented and updated. It aims to present the services provided in the complex, the properties, commercial and service buildings and the information about the events and entertainment in the complex only.
The contents of this website are provided solely for convenience and information of the owners, guests and residents in the complex and the other stakeholders. FPPM does not claim for representation or does not guarantee the thoroughness of the information published on this website.
2. The information on this website, regardless of its actuality on the day of its publication, may not be up-to-date at the moment. Therefore, FPPM advices the users to check for the actuality of the information before using it in any form.
3. All contents on this website are provided without any warranty. FPPM shall not be responsible for any damages, losses, claims, debts, etc. arising out of or resulting from the use or attempts to use the website and the information provided thereon.
4. FPPM has taken and will take all reasonable steps to ensure the accuracy, truthfulness and completeness of the information posted on the website and to prevent the publication of misleading information. However, FPPM does not guarantee the accuracy or completeness of the website contents.

7. FPPM shall not be responsible for the suspension of the website functions, any virus attacks or defects in the server where the website is hosted and any other technical problems related to the proper functioning of the website.
8. FPPM will undertake to ensure the normal use of the website, as far as the provision of its services to the user is not binding and does not guarantee that the services will neither meet the user requirements nor will be continuous, timely or secure. By accepting these rules, the user represents and warrants that he/she will use the services and information provided entirely at his/her own risk and responsibility, as the parties hereby agree that FPPM shall not be responsible for any damage caused to the users due to the use of the website.

11. FPPM shall not be responsible for any damage caused to the software, hardware or equipment of the user or loss of data arising from any materials or resources searched, downloaded or used in any way through the services provided.
12. By accepting these Terms and Conditions the user represents and warrants that he/she is aware of the possibility of any interruption and other difficulties related to the internet connection to the website, which may occur regardless of the efforts made by FPPM. The user represents and warrants that he/she will not claim for any compensation from FPPM for lost profits, property or moral damages incurred or any inconvenience due to the occurrence of the above interruption or difficulties of the Internet connection, including the capacity of this connection.

IV. Copyrights

1. The information resources, materials, images, logos, photographs, text, documents, databases and other information published on the website, as well as all software programmes and applications owned by FPPM and / or its partners or third parties, which have assigned the right of use to FPPM shall be subject to copyright or other intellectual property rights of FPPM.
2. All website contents are protected under the current Copyright Act, Intellectual Property Act, current provisions on the copyright, international agreements and other laws and agreements related to the intellectual property.
3. By using the information services and resources on the website, including by opening the web page of the website and by pressing an electronic link on the home or any other web page on the website the users represent and warrant that they are familiar with these Terms and Conditions, that they accept them and shall comply with them.
To use the services referred to in Section II of these General Terms and Conditions, in the registration process, the user, respectively the parent or guardian of the user, by ticking the box "I agree with the General Terms and Conditions for Using the Website" and pressing the virtual button "Register", makes an electronic statement within the meaning of the Electronic Document and Electronic Signature Act, declaring that he/she is familiar with these Terms and Conditions, accepts them and shall comply with them.

Therefore, FPPM carries out its activities in accordance with the applicable laws on the personal data protection and data security. The policy adopted by FPPM aims to collect, process and store data only to provide the services, facilitate the stay of the guests and owners and ensure complete and quality information to all users.

FPPM is a data controller registered under the Personal Data Protection Act.

1. FPPM stores your personal data (e.g. name, address, telephone number or email address, personal data about any property in the complex, etc.) through this website. FPPM may generate these personal data from its database or you may voluntarily provide them (e.g. by registration, changing the data in the user profile, feedback, inquiries, surveys, etc.).
2. FPPM undertakes to ensure the privacy of the information provided by the users, which contains personal data.
3. FPPM undertakes to collect, process and store the personal data of the users in strict compliance with the provisions of the Personal Data Protection Act of the Republic of Bulgaria.

FPPM undertakes to bear the responsibility for the protection of the user's information, which has become known to it in the provision of the services and processing of the information, except in the cases of force majeure, accidents or malicious acts of third parties and if the user has made this information available to third parties.
5. The registration form, which shall be filled in by the user in the registration process, shall clearly indicate whether the data shall be provided or not and the consequences in case of refusal.
6. By giving his/her consent to these General Terms and Conditions and the privacy policy the user agrees his/her personal information to be processed as provided by the procedures.
7. FPPM shall collect and use the information for the purposes provided for in these General Terms and Conditions, including for company's statistics, offering new services to the users, offering goods and / or services of any third parties, promotions, surveys, lotteries, inquiries via feedback, statistical and other purposes. The above stated purposes, which the information may be used for, are not exhaustive and binding for FPPM.
8. By the registration and adoption of the General Terms and Conditions, rules and policies, the user agrees his/her personal data to be processed for direct marketing purposes, i.e. the user agrees to receive commercial and non-commercial messages, notifications and newsletters, containing information sent by FPPM.
9. The user represents and warrants that FPPM shall be entitled to send messages, notifications or other text to all users in order to offer information about its products and/or services or those of other companies, to make inquiries on various issues, conduct surveys, etc.
10. The user shall be entitled to raise objections to the processing of his/her personal data for direct marketing purposes by sending a written notice to the address or e-mail specified by FPPM.
11. The communication of information about any changes in the registration requirements, General Terms and Conditions for Using the Website or other policies and rules shall not be considered direct marketing.
12. FPPM shall neither edit or disclose any personal information about the user and the services used by him/her nor provide information about the users to any third parties - public authorities, commercial companies, natural persons, etc., except if provided for in the regulations for fulfilment of the FPPM legal obligation related to the administration of the website or when the user has given his/her explicit consent.

FPPM shall not be responsible for and shall not pay compensation to any person, whose personal data have been used by other person to benefit from the services provided by FPPM, whether his/her consent has been given or not.

RULES FOR USING THE FORUM

III. Information provided by the Users of the Forum

Upon registration with the forum of the website the users will be able to share their experiences, publish reviews, comments, personal creativity and other contents.

1. When adding a review / comment to the forum the users agree to comply with the General Terms and Conditions, policies and rules, including the Rules for Using the Forum, as the administrator and owner of the website, the company FPPM, shall not be responsible for any reviews, comments, photographs, etc. shared by the user in the forum.
2. The user shall bear full responsibility for the truthfulness and accuracy of the published information.
3. When uploading images and comments the user agrees that they may be used by FPPM.
4. The user shall not disclose in any manner whatsoever to any third parties published information resources, which contents include text or graphical information, data, audio, files, software, music, video, photographs, audio materials, messages and any other materials or electronic links to materials, which contents are contrary to the legislation of the Republic of Bulgaria, the applicable foreign laws, these General Terms and Conditions, Netiquette, Morality and Decency Rules and contain: violence (including violence against animals), violence campaign, humiliation of the human dignity, threats to the life and physical integrity rights, pornographic or sexual contents, including distinct bodies of victims of accidents and other serious incidents, abusive or threatening as a whole, insulting any religion or containing religious campaign for ethnic and / or racist purposes, trade or business secrets or other confidential information subject to intellectual property rights of third parties, except with the consent of the holder of the right, information infringing any property or moral rights or legitimate interests of any third parties aimed at the discrimination based on sex, race, education, age and religion or preaching fascist, racist or other non-democratic ideology affecting the reputation of the others and calling for violent change of the constitutional order, committing crimes, violence, inflaming racial, ethnic or religious enmity, information encouraging or facilitating terrorist activities, infringing the copyright or intellectual property rights, information about other passwords and access rights without the consent of their holder and software for access to such passwords or rights.
5. In using the website and the forum the user shall not carry out malicious actions within the meaning of these General Terms and Conditions, shall immediately notify FPPM in case of any violation in the use of the services provided, shall not present himself/herself as another person or as a representative of legal person or group of people, whom he/she is not authorized to represent or otherwise mislead the others about his/her identity or affiliation to a certain group of people and shall not use methods leading to load of undesired contents ("pop-up "," blind link "and the like).
6. The user may at any time in its sole discretion terminate the use of the services provided by FPPM by deactivating them from his/her user profile or the designated website or by terminating his/her registration on the website, respectively the use of the services thereon.
7. The users of the website and the forum shall be responsible and shall take the consequences in the cases where they have failed to receive through the website important information about the management of their properties in the complex and / or the management as a whole, the services provided and all other relationships and changes in the complex, which have been announced on the website.
8. FPPM may, in its discretion and without notification, prevent the access to the website and the forum and / or remove user's contents, when they oppose to the requirements provided for in these General Terms and Conditions, the laws of the Republic of Bulgaria and the international law.
9. FPPM may, in its discretion and without notification, prevent or limit the user's access to the website and / or the forum, when, in the discretion of FPPM or according to information obtained by third party, the user benefits from the website and / or the forum in violation of the Bulgarian legislation, these General Terms and Conditions, the decency or any other applicable standards.

ADDITIONAL PROVISIONS

FairPlay Property Management EOOD is a company duly incorporated in the Republic of Bulgaria, which is engaged in property management. All services provided by FPPM and all relationships with the property owners in the complex shall be subject to separate written agreement, which shall become effective upon their signature by the both parties.
FPPM reserves the right to temporarily or permanently terminate the provision of specific information resources, services or other data available through the website.
FPPM reserves the right to amend or update these rules or portions thereof in its discretion at any time. These amendments and updates will become effective immediately upon their publication on the website. By using this website you agree with the published amendments or updates.
Any action, which the users, any third parties or FPPM take to protect the above General Terms and Conditions, shall refer to the Bulgarian court only. If any of these Terms and Conditions is incompatible with the law, void or cannot be applied for whatever reason, it shall be considered invalid and shall not affect in any way the validity of the other Terms and Conditions.

These General Terms and Conditions, rules and policy have been adopted by Decision of the owner FPPM with effect from 1.6.2011.
